Welcome to Black Hammock Farm's website at blackhammockfarm.com (the "Website"). By accessing or using this Website, or by purchasing products or services from Black Hammock Farm, you agree to these Terms and Conditions. If you do not agree, please do not use the Website or our services.


1. Acceptance of Terms

By accessing, browsing, or using this Website, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions and any applicable laws. Continued use of the Website constitutes your acceptance of these Terms.

Black Hammock Farm may update these Terms from time to time. Updates take effect when posted. For significant changes, we'll update the "Last Updated" date at the top of this page. It is your responsibility to review the Terms periodically.


2. Eligibility and Use of the Website

The Website is intended for general audiences. Purchases of products or services, including livestock and Lambscaping engagements, are restricted to individuals 18 years or older. If you are under 18, a parent or guardian must complete the transaction on your behalf.

You agree not to:

  • Interfere with the normal operation of the Website or attempt to bypass any security measures
  • Use automated tools, bots, or scrapers without explicit permission
  • Upload or transmit malicious code, viruses, or harmful components
  • Misrepresent your identity or affiliation
  • Copy, modify, distribute, or create derivative works from Website content without written consent
  • Use the Website to violate any local, state, federal, or international law

We strive to keep the Website available and accurate but cannot guarantee uninterrupted access or freedom from errors. Technical issues and maintenance may cause temporary downtime.


3. Intellectual Property

All content on this Website — including text, photographs, graphics, logos, layout, branding, and the "Lambscaping" name and concept — is the property of Black Hammock Farm and is protected by applicable copyright, trademark, and intellectual property laws. "Lambscaping" is a service name used and claimed by Black Hammock Farm in the State of Florida.

You are granted a limited, non-exclusive, revocable license to access the Website for personal, non-commercial use. You may not:

  • Reproduce, republish, distribute, or commercially exploit Website content without written permission
  • Use Black Hammock Farm logos, brand assets, or the "Lambscaping" name without permission
  • Remove or alter any copyright, trademark, or proprietary notices

4. Products and Services

Black Hammock Farm offers several products and services, including:

  • Live Katahdin sheep and lamb — breeding stock and lamb for the table
  • Heritage chicks and poultry — from our on-farm hatchery
  • Pasture-raised eggs — through the U-Pick It program and Black Hammock Resident program
  • Lambscaping — sheep-based targeted grazing for land clearing
  • Backyard Chickens program — support and mentoring for backyard flock keepers

All products and services are subject to availability. Because we work with live animals and seasonal cycles, availability and timing may vary. Pricing is determined at the time of purchase based on the specific product or service, the animal's characteristics, or the scope of work. Black Hammock Farm reserves the right to limit quantities, decline service, or modify offerings.


5. Payments and Transactions

All transactions with Black Hammock Farm are completed in person at the farm or at the agreed engagement location. We do not process credit cards through the Website and do not maintain an online checkout system.

Accepted payment methods:

  • Cash
  • Venmo
  • Cash App

When you pay through Venmo or Cash App, those transactions are governed by the privacy policies and user agreements of those services. Black Hammock Farm does not store payment card details or banking information.

Deposits and reservations: For livestock preorders, holiday lamb reservations, and Lambscaping engagements, a deposit or full payment may be required to secure your order or booking. Deposit terms are agreed at the time of reservation. Deposits are generally non-refundable except in cases of documented Black Hammock Farm fault.


6. Farm Visits and Agritourism Notice

Black Hammock Farm is a working farm and a registered agritourism operation under Florida law. Visitors are welcome by appointment for U-Pick It pickup, Hatchery tours, Herd visits, Lambscaping site walks, and other farm activities. When you visit the farm, you acknowledge and accept that you are entering a working agricultural environment with live animals, varied terrain, and natural hazards.

FLORIDA AGRITOURISM WARNING (F.S. § 570.89):

"WARNING — Under Florida law, an agritourism professional is not liable for injury or death of, or damage or loss to, a participant in an agritourism activity conducted at this agritourism location if such injury, death, damage, or loss results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury, death, damage, or loss. You are assuming the risk of participating in this agritourism activity."

This statutory notice is also posted physically at the farm entrance as required by Florida law. By visiting the farm, you accept the inherent risks of agritourism and release Black Hammock Farm from liability to the extent provided by Florida Statute § 570.89.

Visitor responsibilities:

  • Follow all posted signs, fencing, and instructions from farm personnel
  • Supervise children at all times
  • Do not feed, handle, or approach animals without explicit permission
  • Wear appropriate clothing and closed-toe footwear
  • Stay within designated visitor areas

7. Lambscaping Service Terms

Lambscaping is Black Hammock Farm's sheep-based targeted grazing service. The following terms apply to all Lambscaping engagements:

Results may vary. Lambscaping outcomes depend on vegetation type, parcel conditions, season, weather, soil moisture, animal density, and engagement duration. Black Hammock Farm provides good-faith estimates of expected results based on site assessment, but does not guarantee a specific level of vegetation reduction, regrowth timeline, or aesthetic outcome.

No liability for incidental damage. Sheep are selective grazers, but their behavior is not entirely predictable. Black Hammock Farm is not liable for damage to plants, ornamentals, irrigation lines, fencing, structures, vehicles, persons, animals, or environmental features that may occur during a Lambscaping engagement. Property owners are responsible for identifying and protecting valuable plantings, sensitive areas, and at-risk infrastructure prior to the start of the engagement.

Animal waste. Sheep manure is a natural byproduct of grazing and provides soil fertility benefit. Black Hammock Farm does not collect, remove, or clean up animal waste from the engagement site. The presence of waste is an inherent part of the service.

Site access and conditions. Property owners are responsible for ensuring the engagement site has trailer access, sufficient water (or arrangement for portable troughs), and reasonable safety conditions. Black Hammock Farm reserves the right to decline or postpone an engagement if site conditions are unsafe or unsuitable for the flock.

Scheduling and cancellation. Lambscaping engagements are scheduled in advance based on flock availability. Cancellations by the property owner within seven (7) days of the scheduled start may result in forfeiture of the deposit. Black Hammock Farm may reschedule due to weather, flock health, or unsafe conditions; in such cases, deposits are honored and applied to the rescheduled date.


8. Educational Content and Advice

Black Hammock Farm shares educational content through this Website, including blog posts (BHF News), FAQs, breed information, and practical guides on raising sheep, poultry, and managing small farms in Florida. This content reflects our own research, observations, and practical farm experience.

Our content is not professional advice. Information shared on this Website does not constitute and should not be relied upon as:

  • Veterinary advice — consult a licensed veterinarian for any animal health concern
  • Legal advice — consult a licensed attorney for legal questions, including agricultural regulations and Greenbelt classification
  • Financial, tax, or insurance advice — consult licensed professionals for advice on your specific situation

9. Livestock Sales

Black Hammock Farm raises and sells live Katahdin sheep, heritage chicks, and heritage poultry. The following terms apply to all livestock sales:

All sales are final. Once livestock leaves the farm, the sale is complete and refunds, returns, or exchanges are not offered, except in cases of documented fault by Black Hammock Farm (such as a misrepresented animal). Buyers are strongly encouraged to inspect animals at the farm prior to purchase.

No warranty of fitness for buyer's purpose. Black Hammock Farm makes no warranty that any animal sold will perform as required for the buyer's specific use, including (but not limited to) breeding success, production levels, temperament for specific environments, suitability for 4-H or youth projects, behavior with other animals, or fitness for any commercial purpose. Buyers are responsible for evaluating whether a specific animal is appropriate for their intended use.

Post-sale health. Animals are sold in good health based on observation at the time of sale. Black Hammock Farm cannot warrant or guarantee animal health, behavior, or performance after the animal leaves the farm, as transportation, environment, care, feed, and exposure to other animals are outside our control.

Buyer responsibilities. By purchasing livestock, you confirm that you have the legal authority, suitable facilities, knowledge, and resources to humanely care for the animal. You are responsible for compliance with all applicable state, county, and local regulations.

Processing. Black Hammock Farm does not provide on-site animal processing. Customers seeking processed lamb may be referred to licensed Florida processors at the customer's expense.


10. Limitation of Liability

The Website and all content, products, and services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the maximum extent permitted by law, Black Hammock Farm disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Black Hammock Farm and its owners, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Website, your purchase of products or services, your visit to the farm, or your application of educational content.

In any event, Black Hammock Farm's total liability for any claim shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

Some jurisdictions do not permit the exclusion of certain warranties or limitations of liability. To the extent those laws apply, some or all of the above disclaimers may not apply to you.


11. Indemnification

You agree to indemnify, defend, and hold harmless Black Hammock Farm and its owners, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Website, your purchase or care of animals after sale, your participation in a Lambscaping engagement, your visit to the farm, your violation of these Terms, or your violation of any third-party rights or applicable law.


12. Force Majeure

Black Hammock Farm shall not be held liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, hurricanes and severe weather, pandemics, government actions, animal disease, power outages, or internet failures.


13. Third-Party Links

The Website may contain links to third-party websites. These links are provided for convenience only and do not signify endorsement. Black Hammock Farm is not responsible for the content, accuracy, or practices of third-party sites. Use such links at your own risk.


14. Privacy

Your use of the Website is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Website, you consent to the practices described in the Privacy Policy.


15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any legal action or proceeding arising from or relating to these Terms or your use of the Website shall be brought exclusively in the state or federal courts located in Seminole County, Florida.

Informal resolution. Before pursuing formal legal action, you agree to contact Black Hammock Farm to attempt an amicable resolution. Both parties will make good-faith efforts to resolve the matter informally within 30 days.

Time limitation. Any claim arising from or related to these Terms or the use of the Website must be filed within one (1) year after such claim arose, or it will be forever barred.

Legal fees. In any legal action arising from these Terms, the prevailing party shall be entitled to recover reasonable attorney's fees and costs.


16. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Black Hammock Farm regarding your use of the Website and our products and services.
